Child Custody and Visitation-- Florida's New Parenting Plan Requirements Effective October !, 2008, Florida law has been substantially revised with regards to custody and visitation. The new law no longer uses the terms "custodial parent", "primary residential parent", "noncustodial parent", "person entitled to be the primary residential parent of a child" and "principal residence of a child". The new law replaces any references to "custody" with the concepts of a "parenting plan" and "time-sharing schedule". The law now requires the parties to submit a written parenting plan for approval by the court. A parenting plan is a document developed and agreed to by the parents of a minor child, and approved by the court, which governs the relationship between the parents regarding the child. A parenting plan may address issues such as the child's education,health care, and physical, social, and emotional well-being, and must include a time sharing schedule. There is no presumption made for or against either parent when a parenting plan is created or modified, and the best interests of the child shall always be the primary consideration. Child Support Florida has adopted the child support guidelines law which has served to standardize the determination of the amount of child support. The support is determined by using both parents incomes and allows for the number of minor children that the parties have together.
